Legal basis for the processing of personal data

1. the processing of personal data is necessary pursuant to a special regulation or an international treaty to which the Slovak Republic is bound. In particular, pursuant to Act No. 222/2004 Coll. on Value Added Tax, as amended.
2. The processing of personal data is necessary for the performance of a contract, due to the legitimate interest of the customer. Thus, the controllers process the personal data of the data subjects, in order to create the opportunity to conclude contracts concluded at a distance or off-premises, on the basis of consent to the processing of the personal data of the data subjects to the extent indicated below.

The processing of personal data is lawful if it is carried out on the basis of at least one of the following legal bases

the data subject has consented to the processing of his or her personal data for at least one specific purpose,
the processing of the personal data is necessary for the performance of a contract to which the data subject is a party or for the performance of a pre-contractual measure at the request of the data subject,
the processing of the personal data is necessary pursuant to a special regulation or an international treaty to which the Slovak Republic is bound,
the processing of personal data is necessary to protect the life, health or property of the data subject or another natural person,
the processing of personal data is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, or
the processing of personal data is necessary for the purposes of the legitimate interests of the controller or of a third party, except where those interests are overridden by the interests or rights of the data subject which require the protection of personal data, in particular where the data subject is a child; this legal basis shall not apply to the processing of personal data by public authorities in the performance of their duties.
Purpose of the processing of personal data

The controller processes the personal data of website users for the purpose of the proper performance of obligations under purchase contracts concluded via the website maintained at www.gwreality.com (hereinafter referred to as “the website”). This means such data as are necessary in particular for:

registration on the website;
the conclusion of the purchase contract;
the processing of the transaction;
delivery of the goods ordered by the user;
the issue of tax documents and their archiving for accounting purposes;
the user to exercise his consumer rights that are due to him by law or from the “GTC” (e.g. the right of withdrawal, the right to claim goods, etc.).

Legal basis for the processing of personal data

Personal data are processed in accordance with Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “the Regulation”) and Act No 18/2018 Coll. on the protection of personal data and on the amendment and supplementation of certain acts (hereinafter referred to as “the Act”).

We process your personal data with your consent, expressed at the moment of registration or order on the website and at the moment of confirmation of the order made on our website.

Your consent to the processing of your personal data is voluntary, however, refusal to give consent will not allow you to register or make purchases through the webshop.

In connection with the processing of your personal data, you have the following rights:

You may withdraw your consent at any time without giving any reason. The notice of withdrawal of consent may relate either to the processing purpose chosen by you, e.g. withdrawal of consent to receive commercial information, or to all processing purposes. Such objections will not affect the processing of the data prior to the receipt of the objections. Lodging objections to the processing of personal data is only relevant for the creation of a personal account (registration) and means that your user account on the website will be deleted and the controllers will no longer process any of your personal data.
You can request that the controllers restrict the processing of your personal data in terms of the processing time or scope – they will process it in accordance with your request. The restriction will not affect the processing of the data prior to receipt of the request.

Retention period of personal data

We keep your personal data until your user account on the website is deleted. Your user account may be deleted at your request or if you withdraw your consent to the processing of your personal data, if you object to the processing of your personal data or if you request its deletion.

Our systems will retain such information for the purpose of archiving your transactions to the extent that the retention of the data is necessary for the exercise of claims such as the right to claim during the warranty period, or if this results from legislative requirements to which we are bound (e.g. for the purpose of proper bookkeeping and archiving of tax documents, we will archive your personal data for the period prescribed for this purpose by the applicable legislation of the Slovak Republic /currently 10 years from the issuance of the invoice/, etc.).

Controllers may entrust the processing of personal data to their business partners in the capacity of intermediaries or employees insofar as this is necessary for the performance of transactions, for example, the administration of the online shop website, the preparation of the goods you have ordered and their transport, or the communication of commercial information prepared by the controllers (e.g. this may concern those users who have consented to the sending of commercial information), or for the purpose of bookkeeping.

Users’ personal data will not be disclosed to third parties in any case or in any way, except for the purposes set out in this Privacy Policy, which means in particular that it will not be shared with other entities for the purpose of sending third parties marketing materials.

The personal data of Website Users will not be transferred outside the European Union countries, but possibly also outside the Slovak Republic.
